Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed bags of bed sheets stacked in a corner of the play room. A plastic container was stored on top of the bags. Licensing is concerned that the bags and they container may fall and harm children.
Corrective Action(s): Please ensure that all items are stored so the do not pose a falling hazard.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The flushing handle on one of the toilets was not working. The staff in charge stated that a plumber had been called and a repair would be made when the facility closes tonight.
Corrective Action(s): Please ensure all areas of the facility are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following were accessible to children during this inspection:
-A black bag of garbage was in the main play area
-Four containers of deodorant were on top of a toilet
-Wires from a cordless phone are loosely attached to a wall and are at chid height
-Cosmetics were stored in an unlocked draw in a washroom
-A bag and a purse containing perfume were stored in the cubby area
-A strip of sharp metal was protruding from a bag in the cubby area
Corrective Action(s): Please ensure that children do not have access to any harmful items

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation (CORRECTED DURING INSPECTION): Hot water temperature in one washroom was measured at 61.6C. The staff person in charge stated they were not aware the water was this hot and will not let the children use this sink until the water temperature is lowered. to prevent scalding hot water accessible to children must be no more than 49C. Licensing reminded the staff person in charge to ensure all staff are aware the children cannot have access to the sink until the water temperature is 49C or lower.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11480 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Cameras are installed throughout the facility providing a live feed available online. The staff person in charge stated that part of the washroom can been seen on the live feed. They stated that staff block the bathroom door or keep the door partly closed while children are in the washroom so that they cannot be seen online. During this inspection Licensing observed the toileting routine and the bathroom door was not blocked or partly closed. Licensing discussed with the person in charge that to protect the dignity of the children the bathroom should not be viewed on the live feed.
Corrective Action(s): Please ensure that camera live feed does not show children while they are in the washroom.

STAFFING: 12010 - CCALA s.7(1)(d) - A licensee must do all of the following: (d) appoint a manager for the community care facility.
Observation: There has been no manager at the facility since February 18, 2019. Licensing had a discussion with the staff person in charge regarding the verbal and email reminders that a new manager needed to be appointed provided to the Licensee Contact. The staff person in charge stated they thought an application for a new manager had been sent by email to Licensing although they acknowledged they had not received any approval. They stated they will submit a new change of manager application. Licensing stated that an application to appoint a person as the manager does not guarantee that it will be approved.
Corrective Action(s): A manager must be appointed by the Licensee to take charge of the day to day operations of the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Files for 6 staff were reviewed. A criminal record check was not available for one staff. The staff in charge stated there is a criminal record check for the staff but were not able to locate it during this inspection.
Corrective Action(s): Please ensure all staff have a criminal record check.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Files for six staff were reviewed. Immunization status was missing in one file.
Corrective Action(s): Please ensure immunization status is available for all staff.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: There are not enough emergency supplies for all of the children for up to 72 hours. The staff person in charge stated that expired supplies had recently been removed from the emergency kit and that they would be replaced soon.
Corrective Action(s): Please ensure that there are adequate emergency supplies for all of the children for up to 72 hours.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The staff person in charge stated that children will be walked to and from kindergarten starting in September. There is no transportation policy for staff to follow when they drop off and pick up children.
Corrective Action(s): Place ensure a policy is in place to guide staff when they drop off and pick up children from school

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: The date of birth for one child had been altered on the registration form and the emergency card by whiting out the original entry and adding a new date of birth. Two birth dates were visible. Licensing was unable to verify the correct age of the child. The staff person in charge stated the child is the correct age to attend the facility. Licensing recommends that if a mistake is made by a family when filling out a form the changes made are initialed by the family.
Corrective Action(s): All information in children's files must be accurate and current.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for nineteen children were reviewed. The telephone number for a doctor was missing for one child.
Corrective Action(s): Please make sure a telephone number is available for all children.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: The last day of care was not recorded for two children.
Corrective Action(s): Please ensure the last day of care is recorded for all children when they leave the facility.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: There is no care plan for a child who is identified as needing extra support.
Corrective Action(s): Please ensure a care pan directing staff actions is available for all children who require extra support.

RECORDS AND REPORTING: 19230 - CCLR s.58(1)(c)(i) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (c) the resources to be made available to the child requiring extra support by the licensee, including (i) any adaptation of the community care facility necessary to ensure the child's safety or comfort.
Observation: There is expired medication at the facility for one child with a care plan.
Corrective Action(s): Please ensure that all medications listed in care plans are current.

Comments

Summary of Inspection
At the inspection dated July 9, 2019 there were 12 children and 3 staff present. At this inspection the above noted contraventions were identified. The Licensee is required to submit a written corrective action plan stating how the contraventions on this report have been addressed. The Licensing Officer will review the plan and conduct a follow up inspection.
The following education/recommendations were provided:
· Promoting active play in the program.
· Temporary Placements
· Active Supervision
Check the expiry date on sunscreen containers to ensure the product has not expired
Licensing strongly recommends that the staff person in charge review the CCALA and the CCLR and ask their Licensing Officer if they have questions.
