3717-1-03.5(A) / Standards of identity
Packaged food labels are not in compliance with standards of identity. Observed a food item icee in the reach-in cooler with no available customer label information. Properly provide: all food items to be packaged in a food service operation or retail food establishment, shall be labeled as specified in 21 C.F.R. 101 and 9 C.F.R. 317. (2) Label information shall include: (a) The common name of the food, or absent a common name, an adequately descriptive identity statement; (b) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors and chemical preservatives, if contained in the food; (c) An accurate declaration of the net quantity of contents; (d) The name and place of business of the manufacturer, packer, or distributor; and (e) The name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient. Observed not all clean utensils, two upper store pots/pans, to be stored in a self-draining position and covered or inverted. properly store all pots/pans in a self-draining position and covered or inverted.

Outdoor refuse containers without tight fitting lids, doors, or covers. Observed the dumpster lid in the open postion in-between uses. properly provide dumpster lids in the closed position in-between uses.

Comments
Received a complaint stating: "They have skinks and rodents running in and out the back door of a restaurant and the trash is consistently creating this issue. Have asked several times for exterminator or treatment to no avail. Now they have a skunk and not just rats".

In today's inspection observed and discussed with management of no evidence of rodents on the exterior and interior of the premise.

Note: management informs they will continue to attempt proper upkeep with the dumpster lids being closed in-between in an effort fully deter any critter or rodent activity.
