3717-1-02.4(B)(1) / PIC: Demonstration of Knowledge - No Critical Violations
Critical Corrected During Inspection PIC unable to demonstrate knowledge by having no critical violations. The Person in Charge (PIC) did not comply with this chapter by having no critical violations during the current inspection. To comply with this Chapter and exercise active managerial control over the facility, the PIC shall have no critical violations during the current inspection, which decreases opportunities for foodborne illness outbreaks. The Inspector reviewed with the PIC the chapters in the Code where the critical violations are addressed. In addition, the Inspector educated the PIC on the public health significance of each critical violation.

Critical Corrected During Inspection Handwashing sink not accessible. Observed fan sitting on top of hand sink located in the food prep. area of the operation. Immediately remove fan, provide hand sink to be free and clear for handwashing to prevent a possible foodborne illness in the operation, maintain at all times. PIC removed the fan from hand sink at time of inspection.

Critical Corrected During Inspection Refrigerated, ready-to-eat, TCS foods not properly date marked. Observed coleslaw in plastic container located in the reach-in cooler without a date mark. The food employee stated that the coleslaw was cold held for two days. To control the growth of pathogens, refrigerated ready to eat TCS foods held for more than twenty-four hours shall be clearly date marked at the time of preparation and sold or discarded within seven days. The day of preparation counts as day one. The PIC voluntarily discarded the coleslaw.
