3717-1-02.4(C)(14) / Person in charge: duties - ensure employees are informed in a verifiable manner of their responsibility to report their health information
Critical Repeat Person in charge did not ensure that employees are informed in a verifiable manner of their responsibility to report information about their health. Observed the RFE without signed employee reporting agreements at time of inspection.
To prevent transmission of foodborne illness, the person in charge shall ensure that food and conditional employees are informed in a verifiable manner of their responsibility to report information about their health as it relates to diseases that are transmissible through food. Owner was given an example that may be implemented to meet the requirements of this rule.
3717-1-03.2(U) / Food display - preventing contamination by consumers.
Critical Repeat Observed food (rice, beans, seeds, etc.) on display was not properly protected from contamination by consumers at the time of inspection. The facility was using a few acceptable containers for peanuts and other dry goods. Per discussion with owner, containers are to large and has ordered smaller NSF containers with lids for all the unpackaged bulk products on display for customer self-service.
To prevent contamination, except for nuts in the shell or whole, raw fruits and vegetables that are intended for hulling, peeling, or washing by the consumer, food on display shall be protected from contamination as required by this rule. Provide lids or similar means for the unprotected products on display for customer self-service.

3717-1-04.1(KK) / Food equipment - certification and classification.
Repeat Observed containers for bulk food items on display not approved by a recognized testing agency at the time of inspection.
To prevent health hazards, food equipment that is acceptable for use in a RFE shall be approved by a recognized food equipment testing agency. Replace containers with approved containers.
3717-1-05.4(O) / Using drain plugs.
Repeat Observed outside waste receptacle drain that did not have a plug at the time of inspection.
To prevent health hazards, drains in receptacles and waste handling units for refuse, recyclables, or returnables shall have drain plugs in place. Contact waste hauler to provide drain plug for receptacle.
3717-1-06.1(M) / Outer openings - protected.
Repeat Observed the back exit door without proper protection against the entry of insects and rodents at the time of inspection. The door was not self-closing and tight-fitting.
To prevent contamination, outer openings of an RFE shall be protected against the entry of insects and rodents as specified in this rule. Except as provided in paragraphs (M)(2) and (M)(3) of this rule, outer openings of an RFE shall be protected against the entry of insects and rodents by: (a) Filling or closing holes and other gaps along floors, walls, and ceilings; (b) Closed, tight-fitting windows; and (c) Solid, self-closing, tight-fitting doors. Repair back door to be self-closing and tight-fitting.

3717-1-02.4(C)(16)/Person in charge: duties - ensure the facility has written procedures for vomiting and diarrheal events.
Observed person-in-charge did not ensure that the facility has written procedures for employees to follow when responding to vomiting or diarrheal events at the time of inspection.
To ensure proper clean-up, person in charge shall ensure that the RFE have written procedures for employees to follow when responding to vomiting or diarrheal events that involved discharge onto surfaces. Develop and implement a clean-up procedure.
3717-1-03.2(Q)/Food storage - preventing contamination from the premises.
Observed improper storage of food items in the walk-in freezer (boxes of food on floor) at the time of inspection.
To prevent health hazards, food shall be protected from contamination by storing the food in a clean, dry location, where it is not exposed to splash, dust, or other contamination, and at least six inches above the floor. Discontinue storing boxes of food directly on the floor.
3717-1-03.4(I)(1)/Time as a public health control - written procedures
Observed time as a public health control was being used without the proper written procedures at the time of inspection. Foods (shrimp, fish) were being held on ice at the time of inspection.
To prevent the growth of pathogens: If time without temperature control is used for TCS food before cooking, or for ready-to-eat TCS food that is displayed or held for sale or service, written procedures that specify methods of compliance with this rule shall be prepared in advance, maintained in the FSO or RFE, and made available to the licensor. Discontinue using ice as cold holding. If RFE wants to continue using ice to keep foods cold a written procedure shall be develop to ensure foods are held properly for food safety. This would require a risk level 4 license.
3717-1-03.5(C)(2)/Food labels - packaged food
Observed labels on a food packaged in the RFE did not contain all required information at the time of inspection.
To properly inform customers, provide the required information on packaged foods. food label information shall include: (a) The common name of the food, or an adequately descriptive identity statement; (b) If made from two or more ingredients, a list of ingredients in descending order of predominance by weight, including a declaration of artificial color or flavor and chemical preservatives, if contained in the food; (c) An accurate declaration of the quantity of contents; (d) The name and place of business of the manufacturer, packer, or distributor; (e) The name of the food source for each major food allergen contained in the food, unless listed in the ingredients; (f) Nutritional information when required by law; and (g) Proper Labeling on container of salmonoid fish containing canthaxanthin. Meats that are recieved with safe handling label shall have the safe handling information transfered when repackaged.
3717-1-04.2(I)/Sanitizing solutions - testing devices.
Observed no test kit available for measuring the concentration of the sanitizer at the time of inspection.
To ensure proper sanitization, a test kit or other device that accurately measures the concentration in PPM (mg/L) of sanitizing solutions shall be provided. Provide proper test kit for sanitizer.
3717-1-04.5(A)(1)/Cleanliness of equipment food-contact surfaces and utensils.
Observed equipment food-contact surfaces or utensils (deli slicer) with an accumulation of food debris at the time of inspection.
To prevent contamination, equipment food-contact surfaces and utensils shall be clean to sight and touch. Clean and maintain the deli slicer. Deli slicer shall be warewashed every 4 hours when in use.
3717-1-04.6(A)/Food-contact surfaces and utensils - sanitization required
Observed equipment food-contact surfaces and utensils were not being sanitized at the time of inspection. RFE had no sanitizer (bleach or quat) available at the time of inspection.
To properly warewash equipment and utensils, equipment food-contact surfaces and utensils shall be sanitized. Obtain sanitizer to be used in the warewashing process and food contact surfaces of equipment/utensils.
3717-1-05.1(S)(2)/Plumbing system - maintained in good repair.
The plumbing system was not properly maintained. Observed a sewer odor in the back restoom at the time of inspection.
To prevent health hazards, a plumbing system shall be properly maintained. Repair plumbing system to be in good working odor. FSO shall be free of sewer odor.
3717-1-05.4(P)/Maintaining refuse areas and enclosures.
Observed an improperly cleaned outside storage area for refuse, recyclables, or returnables at the time of inspection. Observed boxes, mops, garbage outside on the ground around the waste receptacle.
To prevent attracting pests, a storage area and enclosure for refuse, recyclables, or returnables shall be maintained clean and free of unnecessary items. Clean and maintain the outside refuse area.
3717-1-06.4(M)/Storing maintenance tools.
Observed maintenance tools (table saw, 2 reciprocating saws) improperly stored which resulted in contamination at the time of inspection.
To prevent contamination, maintenance tools shall be stored so they do not contaminate food, equipment, utensils, linens, single-service articles, or single-use articles, and in an orderly manner that facilitates cleaning the area used for storing the maintenance tools. Remove saws from RFE or store in closet away from operation's items.
