3717-1-03.2(A)(2) / Preventing contamination from hands - bare hand contact
Critical Corrected During Inspection Improper bare-hand contact with RTE foods. Observed employee using the whip cream without gloves. The tip of the whip cream shall be considered a food contact surface.

3717-1-03.4(H)(1) / Ready-to-eat, time/temperature controlled for safety food - disposition.
Critical Corrected During Inspection Ready-to-eat, TCS food not properly discarded when required. Observed TCS milk products with date marks the exceeded the 7 day discarded as required by food code.

3717-1-05.3(C) / Sewage and other liquid waste: Backflow prevention.
Critical Observed drain lines from Ice maker and Ice bin (main) were not provided with the required air gap. Bracket was in need of repair. Manager contact the service person for repairs.

3717-1-03.4(I)(1) / Time as a public health control - written procedures
No written procedures for time as a public health control. Observed stirring utensils were being rinsed in a water cup then laid in perforated container. Water is not being held cold or hot and is not time monitored to limit the growth of harmful organisms. Provide a procedure regarding how the current process will meet the food code requirements for using Time instead of Temperature for food safety. Recommend discontinuing the current process and using a clean utensil for each beverage then ware washing as needed.

Food employees wearing jewelry on arms or hands during food preparation.

3717-1-02.3(C) / Hair restraints - effectiveness.
Food employee(s) not wearing a hair restraint properly (loose ponytails and facial hair).

3717-1-03.2(K) / In-use utensils - between-use storage.
Corrected During Inspection In-use utensils improperly stored. Observed sifter in bulk sugar with handle in contact with the sugar which is used as a RTE in beverages. Store utensils in a way that prevents the handles from contacting foods.

3717-1-04.8(E)(3) / Single-service articles and single-use articles - storage.
Observed beverage containers not protected from contamination. Containers have been removed from protective plastic and located were the mouth contact point could be contaminated by customers. Protect the mouth contact point by leaving the containers in the plastic wrapper or in an approved storage device.

3717-1-04.1(H) / Nonfood-contact surfaces - cleanability
Nonfood-contact surfaces not easily cleanable. Observed the Turbo Chef mats were discolored, in need of cleaning and damaged. Replace the mats to avoid contamination to foods.

Ensure staff is washing hands before donning gloves (after breaking task).
Ensure food containers are allowed to properly air dry before stacking for storage.
Ensure handles to bulk ingredients are stored with handles not contacting the foods.
Water conditioning devices shall be serviced per the manufacture guidelines.

Managers were able to demonstrate knowledge and urgency to correct violations. All violations will be rechecked at the follow-up inspection.
