Critical Written procedures and plans are not maintained and implemented. The FSO does not have adequate written procedures for the creamer temperature procedure, ware washing procedures, dogs on the patio procedures, and how to proper handle consumer-owned beverage containers. Education was provided to improve food safety.

Critical PIC unable to demonstrate knowledge of storage and use of toxic materials. The PIC was unaware of proper pesticide application, paint storage, cleaning chemical storage and usage. Education was provided to improve chemical usage and storage.

3717-1-02.4(C)(2) / PIC: duties - ensure unnecessary persons are not allowed in food prep or storage areas.
Critical The facility layout is setup in a way that potential customer contamination can not be monitored by the PIC. The roaster, storage areas, "bar", preparation areas, and coffee equipment are not protected from potential contamination from customers. Education was provided to make the PIC aware of potential contamination.

3717-1-02.4(B)(2)(l) / PIC: Demonstration of Knowledge - Identification and protection of water source
Critical PIC unable to demonstrate knowledge of proper water source and preventing contamination. The PIC was unaware of proper backflow prevention for the ice machine and espresso machine. Education was provided to resolve the issues.

3717-1-02.4(C)(14) / PIC: duties - ensure employees are properly trained in food safety, including food allergy awareness.
Critical Person in charge did not ensure their employees are properly trained in food safety. The PIC was unaware of how to properly calibrate a thermometer and there was an inaccurate metal stem thermometer in the kitchen. Education was provided to the staff about proper calibration.

Critical PIC did not ensure employees are properly maintaining temperatures of TCS foods during cold holding of creamer on the counter. Education was provided about creamer temperature procedure to improve food safety procedures.

3717-1-02.4(B)(2)(h) / PIC: Demonstration of Knowledge - Describing relationship between prevention of foodborne illness and management of contamination, hand contact with food, hand washing, and clean facility
Critical PIC unable to demonstrate knowledge of preventing foodborne illness through proper facility maintenance. The PIC was unaware of proper procedures to follow allowing dogs on the patio, preventing customer contamination, and maintaining the facility. Education was provided to improve food safety with regard to facility maintenance.

Critical PIC not ensuring employees are properly sanitizing equipment and utensils and monitoring of sanitizer parameters. The PIC was unaware of proper cleaning and sanitizing procedures for the beverage equipment. Education was provided to improve ware washing procedures.

Critical Food employee did not wash hands when required. The employee failed to wash hands after handling a consumer-owned beverage container that may have led to potential contamination of equipment in the kitchen. Education was provided to improve hand washing procedures after handling consumer-owned beverage containers.

Critical Equipment and utensils contacting TCS food not cleaned every four hours. The PIC stated that the creamer container was not properly cleaned and sanitized every four hours. Once the violation was identified, the PIC stated that the container would be properly ware washed. Education was provided to improve ware washing procedures.

Critical Equipment food-contact surfaces or utensils are unclean (creamer storage container). The PIC stated that the container would be properly ware washed as soon as possible. Education was provided to improve ware washing procedures.

Critical Corrected During Inspection TCS foods not being cold held at the proper temperature. Dairy creamer was cold holding at 46 degrees F on the counter. The PIC immediately and voluntarily discarded the product once the violation was identified. Education was provided to improve cold holding procedures for the creamer.

Critical Improper use of a poisonous or toxic substance. The FSO uses an unapproved cleaning product in the kitchen on food contact surfaces of equipment. Education was provided to PIC about using cleaning products approved for food contact surfaces.

Critical Corrected During Inspection Improper storage of poisonous or toxic materials. Paint was stored under the mop sink. The PIC immediately removed the product from the FSO once the violation was identified.

Critical Improper use of a poisonous or toxic substance. The PIC stated that an unapproved pesticide was applied to treat ants in the FSO. Education was provided to eliminate the usage of unapproved pesticides in the FSO.

Critical Food thermometers are not accurate. One of the two metal stem thermometers in the FSO was not accurately calibrated. The PIC discarded the faulty device once the violation was identified. Education was provided to improve calibration practices.

Critical Food display not properly protected from contamination by consumers. There is no barrier to protect the coffee equipment from potential customer contamination. Education was provided to the PIC to limit potential contamination.

Equipment not approved by a recognized testing agency. A non-commercial storage container was used for baked goods.

Equipment not properly elevated or sealed (espresso machine and display case). Equipment does not allow for proper cleaning because there is no proper seal and/or elevation.

Equipment that dispenses or vends liquid food in unpackaged form not properly designed to protect against contamination. Consumer-owned beverage container filled by the kitchen staff allow for potential contamination of equipment.

A re-inspection will be conducted 3/10/20 to confirm that violations documented during the "consultation" have been corrected.


Dogs on Patio – Rule Summary

(D) Food shall not be provided to dogs in outdoor dining areas, but water may be provided to dogs in single-use disposable containers.

(C) A food service operation or retail food establishment that allows dogs in an outdoor dining area shall:

(1) Post signs near all entrances that notifies patrons that dogs are allowed in outdoor dining areas;

(2) Prohibit dogs from entering the outdoor dining area through any indoor areas.

(3) Prohibit employees from intentionally contacting dogs while working;

(4) Prohibit dogs from being within five feet of areas located in an outdoor dining area that are used for food preparation or for food storage.

(5) Prohibit dogs from sitting, standing, or lying on chairs, seats, benches, counter tops, tables and other furnishings in the outdoor dining area;

(6) Have cleaning supplies and materials readily available to clean up dog hair, feces, urine, vomit and other debris; and

(7) Adopt a written policy that contains at least the following:
(a) Requirements for patrons with a dog in the outdoor dining area to properly control their dog with a leash or other effective means;
(b) Instructions for promptly cleaning up dog hair, feces, urine, vomit, and other debris; and
(c) Requirements for the proper vaccination of all dogs permitted in the outdoor dining area.
