[?] A summary of the violations found during the inspection are listed below.

3717-1-02.4(B) / Person in charge: demonstration of knowledge.
Critical Observed the person in charge was unable to demonstrate proper knowledge of food safety and prevention at time of inspection (date marking procedure).
To prevent or correct factors that may cause foodborne illness, based on the risks inherent to the food operation, during inspections and upon request, the person in charge shall demonstrate to the licensor the applicable food safety knowledge at the time of inspection.
3717-1-02.4(C)(14) / Person in charge: duties - ensure employees are informed in a verifiable manner of their responsibility to report their health information
Critical Person in charge did not ensure that employees are informed in a verifiable manner of their responsibility to report information about their health. Observed the RFE without signed employee reporting agreements at time of inspection.
To prevent transmission of foodborne illness, the person in charge shall ensure that food and conditional employees are informed in a verifiable manner of their responsibility to report information about their health as it relates to diseases that are transmissible through food.
3717-1-03.4(G) / Ready-to-eat, time/temperature controlled for safety food - date marking.
Critical Observed refrigerated, ready-to-eat, TCS foods held refrigerated for more than 24 hours were not properly date marked at time of inspection (chicken, ham, turkey, roast beef, corned beef, and sub sandwiches).
To prevent foodborne illness, refrigerated, ready-to-eat, TCS food held at a temperature of 41°F or less for more than 24 hours shall be clearly marked at the time of preparation or the time the original container is opened to indicate the date or day, that is a maximum of seven days, by which the food shall be consumed, sold, or discarded. The day the food is prepared or opened is day one.
3717-1-03.4(H)(1) / Ready-to-eat, time/temperature controlled for safety food - disposition.
Critical Corrected During Inspection Observed ready-to-eat, TCS food that had been date marked was not properly discarded when required at time of inspection (chicken should have been discarded March 10th).
The PIC voluntarily discarded the chicken at time of inspection. To prevent illness, refrigerated, ready-to-eat TCS food that has been date marked in the facility shall be discarded if it: (a) exceeds the temperature or time specified in (G)(1) of this rule, except the time the food is frozen; (b) is in a container or package that does not bear a date or day; or (c) is marked with a date or day that exceeds the time and temperature combination specified in (G)(1) of this rule.

3717-1-02.4(A)(2) / Person in charge: assignment of responsibility.
Repeat Observed facility did not have one employee with supervisory and management responsibility and the authority to direct and control food preparation and service with level two certification in food protection at time of inspection.
To prevent health hazards, at least one employee that has supervisory and management responsibility and the authority to direct and control food preparation and service shall obtain the level two certification in food protection according to rule 3701-21-25 of the Administrative Code.
3717-1-03.5(C)(2) / Food labels - packaged food
A label on a food packaged in the RFE or FSO did not contain all required information. Observed packaged sub sandwiches without sub-ingredients listed on the label at time of inspection.
To prevent health hazards, provide proper labels. Foods shall be labeled as specified in this rule.
3701-21-25(I) OAC / Level one certification in food protection
Observed the FSO did not have a person in charge that had completed a Level One Certification course at time of inspection.
To prevent health hazards, provide training to all deli staff.
3717-1-06.1(C) / Floor and wall junctures - coved, and enclosed or sealed.
Repeat Observed the floor and wall junctures are not properly coved or closed at time of inspection.
To promote proper cleaning, provide sealed or coved wall junctures. In FSO's or RFE's in which cleaning methods other than water flushing are used for cleaning floors, the floor and wall junctures shall be coved and closed to no larger than one thirty-second inch; where water flush cleaning methods are used, shall be provided with drains and be graded to drain, and the floor and wall junctures shall be coved and sealed.
3717-1-06.2(E) / Handwashing signage.
Observed no handwashing sign posted at handwashing sink used by employees in the restroom at time of inspection.
To promote proper handwashing, a sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees.
3717-1-06.4(A) / Repairing.
Repeat The physical facilities are not being maintained in good repair. Observed the walk in freezer condenser in disrepair. Observed multiple areas of the back room in disrepair (ceiling tiles, walls, and floor) at time of inspection.
To prevent health hazards, repair the facility. The physical facilities shall be maintained in good repair.
901:3-4-15(B) / Embargoing of food due to adulteration, misbranding, or expired baby formula or baby foods
Corrected During Inspection Food in an RFE must be embargoed due to adulteration, misbranding, or baby food or formula is expired. Observed expired baby food for sale at time of inspection.
The PIC voluntarily removed the product at time of inspection. To prevent foodborne illness, whenever a licensor finds or has cause to believe within an RFE or FSO in their jurisdiction that any food is adulterated, or so misbranded as to be dangerous or fraudulent, or that infant formula, or baby food is expired, the licensor shall affix to the item a tag giving notice that the item is, or is suspected of being, adulterated, misbranded, or expired and has been embargoed.

Significant improvement needs to take place regarding proper date marking procedures or risk additional enforcement action.
Provide additional training to all deli staff.
A re-inspection will be conducted on 3/21/18 to confirm that violations have been corrected.
Proper food defense was discussed with the PIC and handouts provided.
The deli is required to receive pre-washed lettuce and tomatoes because there is no food preparation sink.
The deli slicer is required to be completely broken down and properly ware washed every 4 hours that it is used.
