3717-1-02.4(C)(13) / Person in charge: duties - ensure employees are properly trained in food safety, including food allergy awareness.
Critical Repeat Person in charge did not ensure their employees are properly trained in food safety. Observed the FSO without an ODH certified employee in Level 2 food protection at time of inspection.
Obtain an ODH certification in Level 2 food protection. To prevent foodborne illness, the person in charge shall ensure that employees are properly trained in food safety, including food allergy awareness, as it relates to their assigned duties.
3717-1-05.1(O)(2) / Using a handwashing sink - other uses prohibited.
Critical Repeat Handwashing sink is being used for purposes other than handwashing. Observed a garbage disposal in the hand sink at time of inspection.
To prevent contamination, a handwashing sink may not be used for purposes other than handwashing.
3717-1-05.3(C) / Sewage and other liquid waste: Backflow prevention.
Critical Repeat Observed a direct connection between the sewage system and a drain originating from equipment in which food, portable equipment, or utensils are placed at time of inspection (3-compartment sink used to prepare food).
Use a strainer to wash produce until a designated preparation sink can be installed. To prevent health hazards, a direct connection may not exist between the sewage system and a drain originating from equipment in which food, portable equipment, or utensils are placed unless allowed by the Ohio building code for: a warewashing machine between its waste outlet and a floor drain when the machine is located within five feet (1.5 meters) of a trapped floor drain and the machine outlet is connected to the inlet side of a properly vented floor drain trap; or a warewashing and culinary sink.

3717-1-06.4(B) / Cleaning - frequency and restrictions.
Repeat Observed a build-up of dirt, dust, grease, and debris at time of inspection in the following areas: kitchen exhaust hoods.
To prevent contamination, properly clean the exhaust hoods. The physical facilities shall be cleaned as often as necessary to keep them clean, and cleaning shall be done during periods when the least amount of food is exposed.

Equipment food-contact surfaces or utensils are dirty. Observed the interior surfaces of the ice machine to be dirty at time of inspection.
To prevent contamination, equipment food-contact surfaces and utensils shall be clean to sight and touch.
3717-1-06.4(K)/Controlling pests.
Observed the presence of live rodents in the basement at time of inspection (mouse droppings).
Exterminate the mouse infestation by approved methods. To prevent illness, the presence of insects, rodents, and other pests shall be controlled by: Routinely inspecting incoming shipments of food and supplies; routinely inspecting the premises for evidence of pests; Using methods, if pests are found, such as trapping devices or pesticides used according section (C), (K) and (L) of rule 3717-1-07.1 of this code; and eliminating harborage conditions.
3717-1-07.1(C)/Poisonous or toxic materials: Conditions of use.
Observed unapproved application or use of a poisonous or toxic substance. Loose packages of rodent poison were placed in the basement at time of inspection.
Discontinue the practice of using loose packets of rodent poison. Traps and/or temper-resistant bait stations are permitted. To prevent health hazards, poisonous or toxic materials shall be used and applied according to law and as specified in this rule.

Person in charge did not ensure that employees are informed in a verifiable manner of their responsibility to report information about their health. Observed the FSO without signed employee reporting agreements at time of inspection.
To prevent transmission of foodborne illness, the person in charge shall ensure that food and conditional employees are informed in a verifiable manner of their responsibility to report information about their health as it relates to diseases that are transmissible through food.
