3717-1-02.4(B) / Person in charge: demonstration of knowledge.
Critical Repeat The person in charge was unable to demonstrate proper knowledge of food safety and prevention. Observed the FSO with multiple critical violations at time of inspection.
Based on the risks inherent to the food operation, during inspections and upon request the person in charge shall demonstrate to the licensor the applicable food safety knowledge at the time of inspection.
3717-1-05.3(C) / Backflow prevention.
Critical Repeat Observed a direct connection between the sewage system and a drain originating from equipment in which food, portable equipment, or utensils are placed at time of inspection (ice bins and three soda machines).
A direct connection may not exist between the sewage system and a drain originating from equipment in which food, portable equipment, or utensils are placed unless allowed by the Ohio building code.

3717-1-04.1(KK) / Food equipment - certification and classification.
Repeat Equipment is not approved by a recognized testing agency. Observed a non-commercial freezer in use under the front counter at time of inspection.
Food equipment that is acceptable for use in a FSO or RFE shall be approved by a recognized food equipment testing agency.
3717-1-05.3(I) / Other liquid wastes and rainwater.
Repeat Observed improper draining of condensation and other nonsewage liquids at time of inspection. The ice machine drains to the parking lot.
Condensate drainage and other nonsewage liquids and rainwater shall be drained from point of discharge to disposal according to law.

3717-1-03.4(G)/Ready-to-eat, time/temperature controlled for safety food - date marking.
Refrigerated, ready-to-eat, TCS foods held refrigerated for more than 24 hours were not properly date marked. Observed hot dogs, cole slaw, cooked chicken, and lettuce without date marks at time of inspection.
Refrigerated, ready-to-eat, TCS food held refrigerated for more than 24 hours shall be clearly marked at the time of preparation or the time the original container is opened to indicate the date or day to be consumed, sold, or discarded as required in this rule.
3717-1-04.5(A)(1)/Cleanliness of equipment food-contact surfaces and utensils.
Equipment food-contact surfaces or utensils are dirty. Observed the can opener blade to be dirty at time of inspection.
To prevent contamination, equipment food-contact surfaces and utensils shall be clean to sight and touch.
3717-1-04.8(G)/Kitchenware and tableware - handling.
Single-service or single-use articles, kitchenware, or tableware were not handled, displayed, or dispensed properly. Observed spoons to be stored in two directions at time of inspection allowing more than the handles to be contacted.
Single-service articles or single-use articles and cleaned and sanitized utensils shall be handled, displayed, and dispensed so that contamination of food-contact-and lip-contact surfaces is prevented as described in this rule.
3717-1-05.1(G)/Handwashing sinks-Number.
Observed inadequate number of handwashing sinks at time of inspection along the main preparation line.
At least one handwashing sink, a number of handwashing sinks necessary for their convenient use by employees in areas specified under paragraph (L) of this rule, and not fewer than the number of handwashing sinks required by the Ohio building code, shall be provided.
3717-1-06.2(E)/Handwashing signage.
Observed no handwashing sign posted at handwashing sink used by employees at time of inspection in the men's restroom.
A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees.
3717-1-06.4(A)/Repairing.
The physical facilities are not being maintained in good repair. At time of inspection, observed multiple areas of the facility to be in need of repair: several damaged floor tiles in the kitchen and storage areas, several damaged ceiling tiles in the dining room and kitchen, damaged wall near the hand washing sink, and damaged coved base in the walk in cooler and near the office.
The physical facilities shall be maintained in good repair.
3717-1-06.4(B)/Cleaning - frequency and restrictions.
Observed a build-up of dirt, dust, grease, and debris at time of inspection in the following areas: reach-in coolers, reach-in freezers, storage shelves, floor of the walk in cooler, floor in the storage areas, floors under equipment, and floors/walls in the ware washing area.
The physical facilities shall be cleaned as often as necessary to keep them clean, and cleaning shall be done during periods when the least amount of food is exposed.
3717-1-07.1(A)/Storage: separation.
Observed improper storage of poisonous or toxic materials at time of inspection (paints and cleaners) in the storage areas and ware washing area.
Poisonous or toxic materials shall be stored so they cannot contaminate food, equipment, utensils, linens, or single-service or single-use articles .
Comments
Ensure that all hoses are provided with a proper hose bibb ASSE 1011.
Ensure that the hand washing sinks are only used for hand washing.
Ensure ice scoops and storage containers are ware washed every 24 hours.
Ensure food is not stored on the floor of the freezer or the walk in cooler.
Ensure that chili is heated to 165 degrees F within 2 hours before service.
Ensure that all ice cream machines are ware washed every 24 hours unless manufacturer can provide documentation otherwise.

Ensure proper ware washing is done on the trash can used to store milk in the walk in cooler. Label container for "Food storage only". Ensure proper date marking procedures on container.
