3717-1-03.1(A)(3) / Sources - packaged food labeling
Critical Observed food packages (shell eggs) that were not properly labeled at the time of inspection.
To properly inform consumers, packaged food shall be labeled as specified in law.
3717-1-03.4(F)(1) / Time/temperature controlled for safety food - hot and cold holding.
Critical Observed TCS foods (feta cheese, milk, yogurt, and cheddar cheese) stored in the walk in cooler were not being held at the proper temperature at the time of inspection.
Except during preparation, cooking, or cooling, or when time is used as a public health control, TCS food shall be held at 135°F or above (except for those roasts that are cooked as required may be held at 130° F), or at 41°F or less.
3717-1-03.4(G) / Ready-to-eat, time/temperature controlled for safety food - date marking.
Critical Observed refrigerated, ready-to-eat, TCS foods (feta cheese, tabouli, leaf spinach) held refrigerated for more than 24 hours were not properly date marked at the time of inspection.
Refrigerated, ready-to-eat, TCS food held refrigerated for more than 24 hours shall be clearly marked at the time of preparation or the time the original container is opened to indicate the date or day to be consumed, sold, or discarded as required in this rule.
3717-1-04.2(B)(1) / Manual warewashing - three compartment sink required.
Critical Observed no three-compartment sink for the manual washing, rinsing, and sanitizing of utensils at the time of inspection.
A sink with at least three compartments shall be provided for manually washing, rinsing and sanitizing equipment and utensils.
3717-1-04.2(I) / Sanitizing solutions - testing devices.
Critical Observed there was no test kit available for measuring the concentration of the sanitizer at the time of inspection.
A test kit or other device that accurately measures the concentration in PPM (mg/L) of sanitizing solutions shall be provided.
3717-1-06.4(K) / Controlling pests.
Critical Observed evidence for the presence of rodents in the back storage area of the facility at the time of inspection.
The presence of insects, rodents, and other pests shall be controlled by routinely inspecting incoming shipments of food and supplies, and routinely inspecting the premises for evidence of pests, using methods such as trapping devices or pesticides, and eliminating harborage conditions. Contact a licensed pest control agency to eliminate pests.

3717-1-03.2(Q) / Food storage - preventing contamination from the premises.
Observed multiple boxes of crackers, a bag of sugar, and bags of flour in storage on the floor of the facility at the time of inspection.
Food shall be protected from contamination by storing the food in a clean, dry location, where it is not exposed to splash, dust, or other contamination, and at least six inches above the floor.
3717-1-04.4(A)(1) / Equipment - good repair and proper adjustment.
Observed equipment (walk in cooler) was not maintaining TCS foods at an acceptable temperature at the time of inspection.
Equipment shall be maintained in a state of repair and condition that meets the requirements specified under rules 3717-1-04 and 3717-1-04.1 of this code.
3717-1-05.1(I) / Service sink - number.
Observed no service sink or curbed cleaning facility at the time of inspection.
At least one service sink or one curbed cleaning facility equipped with a floor drain shall be provided and conveniently located as specified in this rule.
3717-1-05.4(B) / Outdoor storage surface.
Observed outdoor refuse storage surface was not properly constructed, and sloped to drain at the time of inspection.
An outdoor storage surface for refuse, recyclables, or returnables shall be constructed of nonabsorbent material and shall be smooth, durable, and sloped to drain.
3717-1-06.1(C) / Floor and wall junctures - coved, and enclosed or sealed.
Observed the floor and wall junctures are not properly coved or closed in the back storage area at the time of inspection.
In RFE's in which cleaning methods other than water flushing are used for cleaning floors, the floor and wall junctures shall be coved and closed to no larger than one thirty-second inch; where water flush cleaning methods are used, shall be provided with drains and be graded to drain, and the floor and wall junctures shall be coved and sealed.
3717-1-06.1(M) / Outer openings - protected.
Observed the back door of the facility was not equipped with a self-closing mechanism at the time of inspection for proper protection against the entry of insects and rodents.
To prevent contamination, outer openings of an FSO or RFE shall be protected against the entry of insects and rodents as specified in this rule. Provide the back door with a properly functioning self-closing mechanism.
3717-1-06.4(B) / Cleaning - frequency and restrictions.
Corrected During Inspection Observed an accumulation of pet food in the back storage area of the facility at the time of inspection.
The physical facilities shall be cleaned as often as necessary to keep them clean, and cleaning shall be done during periods when the least amount of food is exposed. Pet food was cleared from the area.
3717-1-06.4(N) / Maintaining premises - unnecessary items and litter.
Observed unnecessary or nonfunctional items and /or litter on the premises (behind the storage building next to the waste receptacle) at the time of inspection..
The premises shall be free of Items that are unnecessary to the operation or maintenance of the FSO or RFE such as equipment that is nonfunctional or no longer used and litter.
