3717-1-02.1(D)(2) / Employee Health: Conditions of exclusion and restriction of food employee w/ diagnosed illness
Critical The firms illness policy only listed the big 5 foodborne illnesses. In Ohio we have 13 foodborne illnesses that employees can not work with. Please update your policy.
To prevent the transmission of foodborne illness, the person in charge shall restrict the duties of a food employee or exclude a food employee diagnosed with illnesses listed in paragraph (A)(2) of this rule.
3717-1-07.1(A) / Poisonous or toxic materials: Storage: separation.
Critical Corrected During Inspection Observed chemical spray bottles stored above packaged ready to eat foods in the back storage area. The person-in-charge moved the bottles. Observed improper storage of poisonous or toxic materials.
To prevent contamination, poisonous or toxic materials shall be stored so they cannot contaminate food, equipment, utensils, linens, or single-service or single-use articles by: 1) Separating the poisonous materials by spacing or partitioning; and 2) Locating the poisonous or toxic materials in an area that is not above food, equipment, utensils, linens, single-service articles or single-use articles. .

3717-1-02.4(A)(2) / Person in charge: assignment of responsibility.
Facility did not have one employee with supervisory and management responsibility and the authority to direct and control food preparation and service with level two certification in food protection.
At least one employee that has supervisory and management responsibility and the authority to direct and control food preparation and service shall obtain the level two certification in food protection according to rule 3701-21-25 of the Administrative Code.
3717-1-02.4(C)(16) / Person in charge: duties - ensure the facility has written procedures for vomiting and diarrheal events.
Person-in-charge did not ensure that the facility has written procedures for employees to follow when responding to vomiting or diarrheal events..
Person in charge shall ensure that the FSO or RFE have written procedures for employees to follow when responding to vomiting or diarrheal events that involved discharge onto surfaces.
3717-1-03.5(C)(3) / Food labels - bulk food
The donuts in the bakery case were not labeled properly.
Bulk food that is available for consumer self-dispensing shall be prominently labeled with the information specified under (C)(2) of this rule.
3717-1-04.1(Y) / Temperature measuring devices.
Observed the external thermometer of the produce walk-in that was off more than 2 degrees Fahrenheit.
A properly designed temperature measuring device as specified in this rule shall be located in the warmest part of a cooling unit or the coolest part of a food warming unit.
3717-1-04.2(I) / Sanitizing solutions - testing devices.
Repeat There is no test kit available for measuring the concentration of the sanitizer at the Bakery and Produce.
To ensure proper sanitization, a test kit or other device that accurately measures the concentration in PPM (mg/L) of sanitizing solutions shall be provided.
3717-1-04.4(A)(1) / Equipment - good repair and proper adjustment.
Repeat Observed a torn gasket on the dairy department cooler door. Equipment and/or components are not maintained in good working order.
Equipment shall be maintained in a state of repair and condition that meets the requirements specified under rules 3717-1-04 and 3717-1-04.1 of this code.
3717-1-04.5(A)(3) / Cleanliness of nonfood-contact surfaces of equipment.
Repeat Observed food build-up on the dairy department self-service shelves. Non-food contact surfaces of equipment are dirty.
Nonfood-contact surfaces of equipment shall be kept clean.
3717-1-05.1(S)(1) / Plumbing system - maintained in good repair.
Observed handsinks that were not working in both men's restrooms.
To prevent health hazards, a plumbing system shall be repaired according to the Ohio building code.
3717-1-06.2(C) / Handwashing sinks - hand drying provision.
Observed no towels or hand drying device at a handwashing sink in the deli and in the meat prep room.
To prevent contamination by hands, each handwashing sink or group of adjacent handwashing sinks shall beprovided with: Individual, disposable towels; a continuous towel system that supplies the user with a clean towel; a heated-air hand drying device; or a hand drying device that employs an air-knife system that delivers high velocity, pressurized air at ambient temperatures.
3717-1-06.4(D) / Cleaning ventilation systems, nuisance and discharge prohibition.
Repeat The ventilation system was not being properly cleaned.
Intake and exhaust air ducts shall be cleaned and filters changed so they are not a source of contamination. If vented to the outside, ventilation systems may not create a public health hazard or nuisance or unlawful discharge.
901:3-4-15(B) / Embargoing of food due to adulteration, misbranding, or expired baby formula or baby foods
Observed 3 pouches of Organic Buttenut Squash that expired on 9/8/2017.
To prevent foodborne illness, whenever a licensor finds or has cause to believe within an RFE or FSO in their jurisdiction that any food is adulterated, or so misbranded as to be dangerous or fraudulent, or that infant formula, or baby food is expired, the licensor shall affix to the item a tag giving notice that the item is, or is suspected of being, adulterated, misbranded, or expired and has been embargoed.
