3717-1-03.4(F)(1) / Time/temperature controlled for safety food - hot and cold holding.
Critical Corrected During Inspection Bratwurst and cut watermelon were not being held at the proper temperature.TCS foods were not being held at the proper temperature.
Observed PIC remove 32 packages of bratwurst and 3 packages of cut watermelons from display coolers. To prevent the growth of pathogens, except during preparation, cooking, or cooling, or when time is used as a public health control, TCS food shall be held at 135°F or above (except that roasts cooked using time and temperature parameters in 3717-1-03.3 may be held at 130° F), or at 41°F or less.
3717-1-06.4(K) / Controlling pests.
Critical Repeat Corrected During Inspection Observed a dust pan in the mop sink behind the produce area with dirt, debris and live insects. Observed the presence of live insects, rodents, and other pests.
To prevent illness, the presence of insects, rodents, and other pests shall be controlled by: Routinely inspecting incoming shipments of food and supplies; routinely inspecting the premises for evidence of pests; Using methods, if pests are found, such as trapping devices or pesticides used according section (C), (K) and (L) of rule 3717-1-07.1 of this code; and eliminating harborage conditions.

3717-1-04.1(Y) / Temperature measuring devices.
Corrected During Inspection Observed no thermometer inside hot holding deli display and inside milk cooler. Cold or hot holding equipment did not contain a thermometer, or the thermometer was not correctly placed.
A properly designed temperature measuring device as specified in this rule shall be located in the warmest part of a cooling unit or the coolest part of a food warming unit.
3717-1-04.4(A)(1) / Equipment - good repair and proper adjustment.
Repeat Observed leak in PVC pipe in front of deli freezer. Observed condensation in deli freezer and in produce freezer along with build up of ice in produce freezer as well. Equipment and/or components are not maintained in good working order.
Equipment shall be maintained in a state of repair and condition that meets the requirements specified under rules 3717-1-04 and 3717-1-04.1 of this code.
3717-1-04.4(A)(1) / Equipment - good repair and proper adjustment.
Repeat Observed torn gasket in deli freezer door and in produce walk in cooler door. Equipment and/or components are not maintained in good working order.
Equipment shall be maintained in a state of repair and condition that meets the requirements specified under rules 3717-1-04 and 3717-1-04.1 of this code.
3717-1-06.4(B) / Cleaning - frequency and restrictions.
Repeat Corrected During Inspection Observed debris on bakery cooler floor.
The physical facilities shall be cleaned as often as necessary to keep them clean, and cleaning shall be done during periods when the least amount of food is exposed.
3717-1-06.4(D) / Cleaning ventilation systems, nuisance and discharge prohibition.
Repeat Observed dirt and debris in the vents of the coolers in deli, produce and bakery sections.The ventilation system was not being properly cleaned or was creating a public health hazard.
Intake and exhaust air ducts shall be cleaned and filters changed so they are not a source of contamination. If vented to the outside, ventilation systems may not create a public health hazard or nuisance or unlawful discharge.
3717-1-06.4(F) / Drying mops.
Corrected During Inspection Observed mops being dried using an unapproved method.
After use, mops shall be placed in a position that allows them to air-dry without soiling walls, equipment, or supplies.
901:3-4-15(B) / Embargoing of food due to adulteration, misbranding, or expired baby formula or baby foods
Repeat Observed 3 packages of Gerber Oganics Apples, Blueberry and Spinach that expired on 5/12/18, 2 packages of Gerber Oganics Apples, Blueberry and Spinach that expired on 2/16/18, 2 Plum Organic packages of Bluberry, Peas and Purple Carrots that expired on 1/12/18, 9 packageds of Similack Go and Grow Formula that expired on 6/01/18, 2 packages of Similac Soy Isomil that expired 5/01/18, 4 packages of Similac Soy Isomil that expired on 6/01/2018, packages of Similac Soy Isomil dated 7/01/2018 was also removed from the shelf and discarded due to company policy, 6 packages of Nutramigan that expired on 5/01/18.
To prevent foodborne illness, whenever a licensor finds or has cause to believe within an RFE or FSO in their jurisdiction that any food is adulterated, or so misbranded as to be dangerous or fraudulent, or that infant formula, or baby food is expired, the licensor shall affix to the item a tag giving notice that the item is, or is suspected of being, adulterated, misbranded, or expired and has been embargoed.
